DropFunnels Affiliate Program Terms of Service
Welcome to the DropFunnels Affiliate Program. By participating in our program, you agree to comply with the following Terms of Service (TOS). Please read them carefully.
1. Affiliate Program Overview
DropFunnels offers an affiliate program to reward partners who promote our products and services. By joining the program, affiliates agree to abide by the terms outlined below.
2. Right to Modify or Terminate
DropFunnels reserves the right to remove and cancel any affiliate’s commissions at any time, for any reason. This includes but is not limited to violations of these terms or any behavior we deem harmful to our brand.
3. Accurate and Up-to-Date Tax Information
All affiliates must provide accurate and up-to-date tax information. This is necessary for the proper processing of payments and to ensure compliance with applicable tax laws. Failure to provide accurate tax information may result in the withholding of payments.
4. Active Subscription Requirement
Affiliates must maintain an active subscription with DropFunnels to be eligible for commissions. This ensures that affiliates are actively using and promoting our products.
5. Changes to Commission Structure
DropFunnels reserves the right to change the affiliate commission payment structure at any time. This includes but is not limited to changes in the percentage of commission paid or the products that are eligible for commissions. Affiliates will be notified of any changes to the commission structure.
6. Commissionable Products
As of July 2024, commissions are only payable on DropFunnels Starter ($99/month) and DropFunnels Ultimate ($299/month) subscriptions. No other products are currently commissionable.
7. Payment Schedule
Affiliates are paid every 90 days. This payment schedule allows us to account for any refunds or chargebacks, ensuring that commissions are only paid on finalized transactions.
8. Compliance and Conduct
Affiliates must comply with all applicable laws and regulations while participating in the DropFunnels Affiliate Program. Any form of unethical or illegal behavior, including but not limited to spamming, false advertising, or using misleading links, is strictly prohibited and will result in immediate termination from the program and forfeiture of any earned commissions.
9. Termination of Participation
DropFunnels reserves the right to terminate any affiliate’s participation in the program at any time, with or without cause. Upon termination, the affiliate must immediately cease promoting DropFunnels and remove all links, banners, and other promotional materials from their site.
10. Limitation of Liability
DropFunnels will not be liable for any indirect, incidental, special, or consequential damages arising in connection with this agreement or the affiliate program. Our total liability to you for any cause of action arising out of or related to the program shall be limited to the amount paid or payable to you under this agreement.
11. Governing Law
These terms and conditions will be governed by and construed in accordance with the laws of the state of California, without regard to its conflict of law principles.
12. Agreement
By joining the DropFunnels Affiliate Program, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions. If you do not agree to these terms, you should not join or continue participating in the program.
13. Promotional Methods
Affiliates are expected to employ ethical promotional methods to market DropFunnels. Acceptable methods include, but are not limited to, blogging, social media marketing, email marketing, and paid advertising. Affiliates are expressly prohibited from engaging in paid advertising campaigns that target our brand keywords or directly link to our domain, including but not limited to Google Ads or similar platforms. Additionally, affiliates must avoid any deceptive or misleading marketing practices.
Affiliates found to be promoting direct competitors over DropFunnels or violating these advertising restrictions will face immediate removal from the program. Furthermore, any commissions earned by the affiliate, including those accrued prior to the violation, will be forfeited. The company reserves the right to take legal action if necessary to enforce these terms.
14. Use of DropFunnels Brand
Affiliates may use the DropFunnels brand, logo, and promotional materials provided by DropFunnels. However, any use of the brand must comply with DropFunnels’ branding guidelines and must not tarnish or misrepresent the DropFunnels brand.
15. Confidentiality
Affiliates must maintain the confidentiality of all proprietary information and terms of the affiliate program. This includes commission rates, payment structures, and any other information that is not publicly available.
16. Self-Referrals
Affiliates are not permitted to refer themselves, create multiple accounts, or engage in any other fraudulent activity to earn commissions. Any such activity will result in the immediate termination of the affiliate account and forfeiture of any earned commissions.
17. Relationship of Parties
Affiliates are independent contractors and nothing in this agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the affiliate and DropFunnels. Affiliates have no authority to make or accept any offers or representations on behalf of DropFunnels.
18. Indemnification
Affiliates agree to indemnify, defend, and hold harmless DropFunnels and its subsidiaries, affiliates, and employees from any claim, damage, lawsuit, action, complaint, or other costs arising out of any breach of these terms by the affiliate or any actions by the affiliate in connection with the affiliate program.
19. Modification of Terms
DropFunnels reserves the right to modify these terms at any time. Affiliates will be notified of any changes to the terms and continued participation in the affiliate program will constitute acceptance of the modified terms.
20. Reporting and Tracking
DropFunnels provides a reporting system for affiliates to track their referrals, sales, and commissions. Affiliates are responsible for ensuring that their referral links are properly formatted and that their referrals are accurately tracked. DropFunnels is not responsible for any tracking errors or discrepancies.
21. Payments and Fees
Commission payments will be made via the payment method selected by the affiliate during registration. Any fees associated with the payment method, such as transaction fees, currency conversion fees, or wire transfer fees, will be the responsibility of the affiliate and deducted from the commission payment. Additionally, any payment processing fees incurred from the transactions referred by the affiliate will also be deducted from the commission.
22. Minimum Payout Threshold
DropFunnels has a minimum payout threshold of $600. Commissions will only be paid out once the affiliate's earnings reach this threshold. If the threshold is not met, the commissions will roll over to the next payment cycle.
23. Compliance with FTC Guidelines
Affiliates must comply with all Federal Trade Commission (FTC) guidelines and regulations regarding advertising and marketing disclosures. This includes clearly disclosing the affiliate relationship with DropFunnels in all promotions and communications.
24. Prohibited Activities
Affiliates are prohibited from engaging in the following activities:
- Bidding on DropFunnels trademarks, including any variations or misspellings, in any pay-per-click (PPC) advertising.
- Using cookie stuffing techniques that set tracking cookies without the user’s knowledge.
- Engaging in any form of incentivized traffic that results in misleading or fraudulent conversions.
- Using unauthorized links, banners, or other promotional materials.
25. Account Security
Affiliates are responsible for maintaining the security of their affiliate account login information. DropFunnels will not be liable for any loss or damage arising from the affiliate’s failure to protect their account credentials.
26. Support and Resources
DropFunnels provides support and resources to help affiliates succeed in the program. This includes access to marketing materials, training resources, and a dedicated affiliate support team. Affiliates are encouraged to utilize these resources to maximize their promotional efforts.
27. Communication and Updates
DropFunnels may communicate with affiliates via email, newsletters, or the affiliate dashboard. It is the affiliate’s responsibility to keep their contact information up to date and to regularly check for updates or important announcements.
28. Dispute Resolution
Any disputes arising out of or related to the affiliate program will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will take place in California, and the arbitrator’s decision will be final and binding. The affiliate will be responsible for paying all arbitration costs.
